| Mullin Awning and Siding
("Mullin") warrants its installation workmanship for the products named in this
paragraph and installed by Mullin on your home, for a period of twenty (20) years as
described below. Mullin warrants that all installation work it performs will be free of
defects and be accomplished according to manufacturers' installation instructions or
accepted industry standards and practices. This installation warranty is effective with
respect to installation of the following products only: Vinyl Siding, Steel Siding,
Replacement Windows, Storm Windows, Storm Doors, Soffit, Fascia Trim, Window Casing Trim,
Patio Covers, and Room Additions. This warranty does not cover installation of any other
products or to commercial installation of these products.During such period, Mullin's obligation hereunder
shall be limited solely to furnishing labor to repair any defective installation
workmanship (and to also provide replacement materials when necessary to make such
repairs), the cost of which shall be prorated between Mullin and the homeowner(s) on the
following basis: During the first year after the date of initial product installation,
Mullin shall pay 100% of the cost of providing repair labor and materials as described
above; during the second year after the date of initial product installation, Mullin shall
pay 95% of the cost and the homeowner(s) shall pay 5% of the cost; for the third year and
each of the subsequent years after the date of initial product installation, to and
including the twentieth year, the homeowner(s) shall pay an additional 5% per year of the
cost and Mullin shall pay the balance. Should it become necessary for Mullin to provide
replacement materials to make such repairs, Mullin shall have the right to substitute
materials that it considers to be of equal value if materials identical to those
originally installed are not available to Mullin when such repairs are performed. In all
cases, Mullin will be the sole provider of labor and materials used to make repairs under
this warranty. The homeowner(s) may not contract with another to provide such labor or
materials unless directed to do so by Mullin.
Mullin makes no warranties that extend beyond the face
hereof, and Mullin shall not be liable to the homeowner(s) for incidental or consequential
damages for breach of any written or oral express or implied warranty on its installation
workmanship. |
The total liability of Mullin for a
claim under this warranty shall be limited to, and in no account shall exceed, the total
installed cost of the home improvement products it originally installed. Mullin does not
warrant against and shall not be liable for any damage due to or caused by manufacturing
defects, accidental or intentional damage, abuse, misuse, fire, flood, moisture, water,
humidity retention or accumulation, mildew, infiltration, windstorm, earthquake, acts of
God, ice, hail or weather of a catastrophic nature as defined by the United States Weather
Bureau, settlement or deterioration of the building structure, improper care, adverse
effects of pollution, normal weathering of surfaces, impact of foreign objects, and causes
or damages beyond the control of Mullin. all warranties either express or implied,
including warranties of merchantability or fitness for a particular purpose are limited to
the term hereof. some states do not allow limitation on how long an implied warranty
lasts, and so the above limitation may not apply to you. some states do not allow
exclusions or limitations on incidental or consequential damages, and so the above
limitations or exclusions may not apply to you. this warranty gives you specific legal
rights and you may also have other rights that vary from state to state. If you think that the product you purchased from
Mullin was not installed correctly, you must notify Mullin in writing at 811 Steuben
Street, Sioux City, Iowa 51101, within a reasonable time after discovering the defect. If
you choose to exercise your rights under this warranty, do not begin any repairs prior to
notifying Mullin. Some methods of remedy may ruin the product, making it impossible for
Mullin to repair. Further, Mullin must be given a reasonable opportunity to inspect the
job for defects before repairs are begun.
This warranty is freely transferable to
subsequent purchasers of the home, provided that Mullin must be given written notification
of said transfer within thirty (30) days from the date of title transfer. In the event
that written notification of transfer is not received as stated above, then this warranty
and Mullin's obligations hereunder shall be deemed terminated. Liability of Mullin in
event of transfer shall be limited, as specified above, to the term of the warranty then
remaining. |
